To make purchases from www.loja.serralves.pt, the customer must have an email address, hereinafter solely called “e-mail”, and create a customer account on Serralves Shop’s site.

Placing an order at www.loja.serralves.pt involves straightforward steps:

1. Find the products you want to purchase;

2. Add the selected products to the Cart;

3. Finalise the purchase;

4. Select the payment option;

5. Review your order;

6. Proceed to payment and confirm the order;

7. You will receive an order confirmation by email;

Your order is confirmed when you click on the "Confirm Payment" (Checkout) button at the end of the purchase process.

Confirmation of your order will be sent to your email address.

The Serralves Foundation reserves the right not to accept your order and to cancel it, even after it has been automatically confirmed, if this proves to be necessary. This decision will be sent to the email associated to your customer account.

By sending the order form you are accepting the general conditions that govern your purchase, as well as all conditions in force at www.loja.serralves.pt and www.serralves.pt.

1.2. Right to refuse the order or cancel the purchase

The Serralves Foundation reserves the right not to process any incomplete or incorrect orders, or if the ordered products are no longer available. The Serralves Foundation also reserves the right to cancel any purchase, even if it has already been accepted, in the following situations, among others:

1. The product is no longer available / in stock (any payments already made for the product will be returned);

2. The billing information is not correct or verifiable;

3. The order is signalled by our Security Systems as an incorrect order or as potentially fraudulent;

4. Payment was not received by the Serralves Foundation within 5 working days after acceptance of your order;

5. If there is evidence that you are under 16;

6. If there is evidence that you are a reseller;

7. If it is not possible to deliver to the indicated address.

In these referred cases, you will be informed by e-mail that the purchase and sale contract has not been signed and that the vendor has not proceeded with the sale, specifying the respective reasons.

If the products presented in the online shop were no longer available at the time of your last access, or when Serralves Shop received the order, the latter must inform you of the unavailability of the products within 30 days after receiving the order.

If an order has been placed and there has been payment for products that are no longer available, Serralves Shop will refund all amounts paid for unavailable items.

The Serralves Foundation does not accept any liability and will not be held liable, for whatever reason, for non-acceptance of any order or for cancellation of the purchase and sale, in particular with regard to the return of any costs incurred by the Client with the transactions, any other expenses that may have been incurred or other monetary values, either in the form of compensation or an indemnity payment.

1.3. Data verification

After receiving the order we may conduct some checks in relation to it, before we prepare the order.

Such checks may include verification of the address, credibility and potential fraud. For the purposes of verification of potential fraud, we conduct partially automated checks on all orders, to filter out unusual or suspicious transactions or those identified to be susceptible to fraud. Suspected fraud will be treated in accordance with the provisions specified in the legislation on this matter. When you confirm your order, this means that you agree to these conditions.

1.4. Payment methods

The different available payment methods are specified in the Delivery and Payment section of Serralves Shop’s online service. The Serralves Foundation does not accept any payment method other than those specified. If you try to pay using any method other than the authorized methods, the Serralves Foundation cannot be held liable for the loss of the payment amount or any other costs or damages that may be incurred by the Client.

2. RETENTION OF TITLE

Serralves Shop retains ownership of the products until it has received full payment for all of them.

3. PRICES

The prices of the products displayed at www.loja.serralves.pt include Value Added Tax (VAT). Delivery costs shall be applied to each order on an itemised basis. The exact delivery cost and the applicable fees will depend on the country to which the order will be delivered and its total weight. For additional information on delivery costs per country, see the website’s Delivery and Payment section.

Prices are quoted exclusively in euros. Please note that changing the country of delivery may have an influence on the final prices due to the delivery costs.

3.1. The total price

The total price specified in the final checkout menu includes taxes and delivery costs. Prices are specified at the time when the order is confirmed, which you can print or download for future use. Please only pay the exact amount specified in the order confirmation and make individual payments for each order.

3.2. Price changes

The prices of products displayed on the website are subject to change. The Serralves Foundation reserves the right to change prices without any prior notice. The prices of each product at the time of purchase are the prices applied to that purchase.

3.3. Pricing errors

It should be noted that even though Serralves Shop Online is updated with extreme care, it is possible that the price information on the website contains errors. Serralves Shop does not undertake to complete the order and reserves the right to cancel your order, in the event of a pricing error.

3.4. Conditions applicable to Promotional Codes (discounts)

When used according to the established rules, a promotional code enables the client to use a special offer / discount related to the purchase of a specific product or for a set of products, during the period indicated / associated to the promotional code / promotional campaign.

Promotional codes can only be used for online purchases made via the website. The sale, exchange or donation of a promotional code is prohibited. A customer with a promotional code cannot upload it or make it available on any website or other public form of offer, donation, sale or exchange. The use of promotional codes for commercial purposes is prohibited.

A promotional code cannot be used in an illegal, abusive or disrespectful manner, or in any other way that could damage the reputation of Serralves Shop.

Promotional codes are not exchangeable / exchangeable for cash.

Serralves Shop has no obligation to reissue or refund promotional codes. However, if Serralves Shop does decide to reissue or refund a promotional code, you must have access to the initial promotional code. For this purpose, you must keep a copy of your promotional code, otherwise it cannot be reissued or replaced in the event of loss.

3.5. Validity of special offers

Special offers on the website are valid only for the time that they are displayed therein, unless otherwise stated on the website.

4. AVAILABILITY

Completion of all orders made via the website is subject to availability. Serralves Shop tries to ensure that all items offered for sale on the website are in stock. However, Serralves Shop reserves the right not to accept any orders, or cancel orders that have already been confirmed, if products are no longer in stock. In these cases, Serralves Shop will inform the customer of this fact and will refund the amount paid.

5. QUALITY AND GUARANTEE

Serralves Shop Online does not sell second-hand products, or products that are defective or of inferior quality to standard products available in the market. The main characteristics of each product displayed on www.loja.serralves.pt can be found on each product page.

If you decide to exercise your right to return any purchased products, Serralves Shop has the right not to accept products that are returned without the original packaging or that have been altered from their original state, or are damaged.

7. LIABILITY

Serralves Shop will only be liable for damages incurred by the client in the event that such damages result from breaches that may be attributed to Serralves Shop’s contractual obligations towards the client, or in the event that Serralves Shop' liability results from applicable legislation.

Serralves Shop cannot be held liable for damages suffered by third parties as a result of using any of the products they sell. Serralves Shop cannot be held liable for damages incurred by the customer as a result of improper use of our products.

In the event that the customer incurs damages that result from serious negligence or fraud by Serralves Shop, none of the limitations specified above in this article apply.

8. INFORMATION ON THE SITE

Although Serralves Shop maintains its website with great care, the specified information, texts, graphic documents, films, music and / or other services may contain errors or be incomplete or incorrect. Serralves Shop cannot be held liable for any damages resulting from use of (or inability to use) the website, including damages caused by computer viruses or any inaccuracy or imperfection of the information, unless such damage is the result of intent or negligence by Serralves Shop.

9. CHANGE OF TERMS AND CONDITIONS BY SERRALVES SHOP

Serralves Shop has the right to change these Terms and Conditions at any time. The customer is bound by the principles and terms in force on the date when the order is placed, unless the respective legislation or competent authority imposes any changes thereof.
